Last updated 03 October 2025. By registering, bidding, purchasing, or collecting a vehicle, the Buyer agrees to these Terms & Conditions in full. Sales are trade‑only; consumer law does not apply.

1) Introduction & Scope
  • These Terms & Conditions (“T&Cs”) govern all auctions and sales by Seized & Salvaged Ltd (“the Company”).
  • By registering, bidding, or purchasing, the Buyer agrees to be bound by these T&Cs.
  • Trade‑only sales: The Consumer Rights Act 2015 and other consumer legislation do not apply.
  • These T&Cs supersede any prior statements or descriptions, written or oral.
2) Registration & Eligibility
  • Buyers must register with valid photo ID, proof of address, and business details as requested.
  • We may request and hold a refundable bidding deposit (offset against the balance if you purchase).
  • We may refuse or cancel registration or bidding rights at our absolute discretion.
  • Minimum age 18. By registering, you confirm you are legally capable of entering binding contracts.
3) Bidding Rules
  • All bids are legally binding and cannot be withdrawn once placed.
  • A binding contract forms immediately when your bid is accepted.
  • We may reject or cancel any bid and may re‑offer lots at our discretion.
  • Shill bidding, collusion, or fraud will result in a permanent ban and may be reported to authorities.
4) Deposits
  • Deposits may be required on certain vehicles or accounts.
  • Deposits are strictly non‑refundable in all circumstances, including change of mind or failure to complete.
  • Deposits may be set off against the final purchase price on completion.
5) Payment Terms (48 Hours)
  • Full cleared payment is due within 48 hours of invoice/date of purchase.
  • Accepted: Bank Transfer (preferred) or Cash in office (subject to AML limits).
  • Not accepted: cheques, card payments, PayPal.
  • VAT: all prices are exclusive of VAT unless stated; VAT applies where applicable.
  • Vehicles are not released until funds are cleared in our bank account.
6) Vehicle Collection (7 Days)
  • Collection within 7 calendar days (by appointment during working hours).
  • Removal must be by recovery truck or trailer unless we grant written permission to drive away.
  • The Buyer is responsible for lawful, safe recovery and for providing proof of payment on collection.
7) Storage & Abandonment
  • First 7 days free storage. From Day 8 a storage charge of £25 + VAT/day applies per vehicle.
  • Storage and any other outstanding charges must be paid before release.
  • Vehicles not collected within 14 days may be re‑listed or resold to recover costs.
  • Vehicles left beyond 28 days are deemed abandoned; ownership reverts to the Company with no refund. Buyer remains liable for storage/admin up to disposal.
8) Vehicle Condition & Descriptions – Sold As Seen
  • All vehicles are sold strictly “as seen”, without warranty or guarantee, and with all faults (if any), whether apparent or hidden.
  • Descriptions, photos, mileages and specifications are provided in good faith but are not guaranteed.
  • Odometer readings should be treated as inaccurate. Vehicles may have undeclared faults or missing parts.
  • Vehicles may be insurance write‑off categories (A, B, S, N etc.), subject to outstanding finance, or police seizure. Buyers must perform their own HPI/finance checks.
  • Vehicles are not road‑tested; any remark such as “starts” or “drives” refers only to a brief yard test performed at the time of listing or handover. It is not a warranty or assurance that the vehicle will continue to start, drive, or operate correctly after purchase or once removed from our premises.
  • This Sold‑As‑Seen clause applies even where collection is by a third‑party transporter. Once the vehicle leaves our premises, no returns/claims.
9) Buyer Responsibilities
  • Inspect vehicles prior to bidding and conduct due diligence (HPI, finance, MOT, recalls).
  • Ensure vehicles are repaired, roadworthy, registered/taxed and insured before road use.
  • Comply with DVLA, road traffic and health & safety laws at all times.
10) Title & Risk
  • Title passes only upon receipt of full cleared funds.
  • Risk transfers to the Buyer on collection/removal from our premises.
  • No liability is accepted for loss, theft or damage after risk has passed.
11) Defaults
  • Default includes: failure to pay within 48 hours, failure to collect within 7 days, or refusal to pay storage/admin charges.
  • On default: deposits are forfeited, vehicles may be re‑listed or resold, and the Buyer is liable for losses, costs and fees.
  • We may pursue outstanding sums via debt recovery or legal action and bar Buyers from future sales.
12) Conduct on Premises
  • Follow staff instructions and site safety rules. PPE (e.g. high‑vis, safety boots) may be required.
  • Unauthorised persons (children, pets) are not permitted in storage/loading areas.
  • Alcohol, drugs and smoking are prohibited on site.
  • The Buyer is responsible for the conduct of recovery drivers/agents.
13) Indemnity

The Buyer agrees to indemnify and hold harmless the Company, its directors, staff and agents from all claims, liabilities, damages, losses and expenses arising from:

  • Use/misuse of any vehicle purchased;
  • Accident, injury or death involving the vehicle post‑collection;
  • Any breach of law or regulation by the Buyer;
  • Third‑party claims relating to the vehicle after collection.
14) Limitation of Liability
  • We are not liable for indirect, special or consequential loss, loss of profit or business interruption.
  • We are not liable for repair costs, recovery costs or resale losses.
  • Our maximum liability shall not exceed the purchase price paid for the vehicle.
15) Data Protection & Complaints
  • We process personal data for administration, legal compliance, fraud prevention and debt recovery in accordance with UK GDPR.
  • Data may be shared with insurers, finance companies, law enforcement and recovery agents where necessary.
  • Complaints must be raised in writing before leaving site. Once a vehicle leaves, no claims or disputes will be entertained.
16) Force Majeure

We are not liable for any failure or delay due to events beyond our reasonable control (including strikes, accidents, fire, flood, theft, IT outages, or government restrictions).

17) Governing Law & Jurisdiction

These T&Cs are governed by the laws of England & Wales. Courts of England & Wales have exclusive jurisdiction.

Important Notice: All vehicles are salvage vehicles, not retail‑ready and may not be roadworthy. No warranty, refund or guarantee is offered. By bidding/purchasing, the Buyer accepts full responsibility for future costs, repairs, safety and use.
